Congressional Structured Settlements Caucus

Monday marked the start of an exciting journey for the structured settlements industry and NSSTA. On July 29, 2013, Congressman John Lewis (DGA)distributed a letter to every member in the U.S. House of Representatives, inviting them to join the new Congressional Structured Settlements Caucus.

In his letter, Congressman Lewis urged members of the House to become a member of the Caucus, which “will highlight one of Congress’ great bipartisan policy successes during the past 30 years.” Lewis reminded his colleagues that structured settlements are “a clear cut example of congressional policy working, as intended, to protect the long-term economic security and health of accident survivors and avoid the need for public assistance.” Read more…

Pain Disorders and the New DSM-5

“In May 2013, the Diagnostic and Statistical Manual of Mental Disorders, Fifth Edition (DSM-5) was published by the American Psychiatric Association. There are many changes in the names and diagnostic criteria of certain psychiatric disorders that are frequently encountered in work related injury cases. The diagnostic criteria for pain disorder that was included in the DSM-IV-TR has been eliminated in the DSM-5.

Instead, pain disorders are now included within a new diagnostic criteria called Somatic Symptom and Related Disorders. The common feature of this disorder category is that individuals have “somatic symptoms associated with significant distress and impairment.” The introduction to this new disorder includes the description of the diagnosis is to be made “on the basis of positive symptoms and signs (distressing somatic symptoms plus abnormal thoughts, feelings, and behaviors in response to these symptoms) rather than the absence of a medical explanation for somatic complaints.” (See DSM-5, p. 309.)” Read more…
