One man’s efforts to run a workers compensation scam did not score well with authorities in the Sacramento area.
Deputy District Attorney Jeanne McCullough, Insurance Fraud Unit, and
District Attorney Anne Marie Schubert announced that Ernesto Rodriguez pled no contest to felony workers comp fraud.
On June 5, 2012, Rodriguez filed a workers comp claim stating on May 25, 2012, he was injured when a lawn mower hit his leg while working for a landscaping company. He was diagnosed with a spiral fracture of the tibia in his left leg, which required surgery to insert a nail into the bone to facilitate healing.
An investigation by the Sacramento County District Attorney’s Office, in conjunction with investigators representing Athens Insurance Company, revealed Rodriguez sustained the injury in a soccer game two days after the date he claimed he was injured at work. He applied for and received approximately $1,000 from the soccer league for the injury. Rodriguez lied to his doctors and to Athens Insurance Company as to how, where, and when his injury occurred.
Rodriguez was sentenced before the Honorable Michael Bowman to 120 days county jail and 5 years of formal probation.
He was also ordered to repay all the costs incurred and associated with his claim in the amount of $36,404.34 payable to Athens Insurance Company.
